Wills, Trusts, Tax and Probate
Have You Made Your Will?
Failure to make a Will could mean that all you have worked for goes to someone you didn't intend to benefit (including the Tax Man). For most people, making a Will is straightforward and inexpensive. We will look after the original in our strong room at no cost and give you a copy to keep with your papers. Don't put it off!
Have You Considered a "Living Will"?
More and more people are concerned that in the event of serious illness or incapacity, their wishes regarding medical treatment should be respected. We can prepare a form of "Living Will" to record your instructions, e.g. to nominate a friend or relative you would wish to be consulted about future medical treatment.
Inheritance Tax
This may be payable on your estate when you die if it exceeds the exemption limit. Sometimes Inheritance Tax can be charged on gifts made in your lifetime. Proper advice at the right time can save money and worry.
Have You Considered a Power of Attorney?
Appointing a friend or relative to be your Attorney can ensure your affairs are dealt with as you would wish even if you are unable to manage them yourself. Powers of Attorney are increasingly used within the families to deal with such situations – and they are usually straightforward, inexpensive and effective.
Protecting Your Family Home
Many people are concerned to ensure that their house is protected, should they need to go into residential or nursing care. There are a number of potential pitfalls for the unwary. Please ask our advice for the options available to you and your family.
When Someone Dies
If a Will has been made, the appointed executors will usually need to apply for a Grant of Probate so that they can deal with the estate, pay any tax and debts and distribute the balance to the beneficiaries. If no Will has been made, a Grant of Letters of Administration will be needed and the estate will be distributed to the deceased’s next of kin under the intestacy rules. If you are an executor or next of kin, we can help you through the process. With the right help and some careful planning, many difficulties can be avoided. We shall be pleased to look at your particular circumstances and advise accordingly.
