Case Study 1
A GP in a practice was suffering because of personality conflicts with his colleagues. It was not possible to achieve a negotiated settlement. But by liaising with the PCT concerned an acceptable split of the practice was achieved, enabling the client to establish his own practice with his patients before later joining another practice of his choice some time later after the dust had settled.
Case Study 2
An established practice had been laid back about the terms on which partners were admitted. When one partner decided to leave the practice, the financial terms applicable were uncertain and therefore disputed: the old partnership agreement - which had never been signed by the outgoing partner - was at odds with the expectations of the doctor.
Prompt advice was given as to what terms actually applied and therefore who was right and who was wrong. Unsurprisingly it did not please everyone. It avoided a potential dispute from escalating into an expensive row and the parting was achieved in an acceptable timescale and was reasonably amicable.
Case Study 3
In this practice, some doctors were coming up to retirement. However, although the premises were valuable, there was the potential of considerably more value being added in the event of a move to new premises which would release the existing premises for development. But the timescale for development was uncertain and until the outgoing partners, who had cut back their hours, actually retired, new partners could not be brought in to the practice.
A formula was drafted for dealing with the development value which satisfied the outgoing partners as well as those remaining and which enabled new partners to be brought in.
