Business Law | Business Transfers & TUPE
The Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE) aims to protect employees' rights when a business or part of a business changes hands. It also applies when the provider of a particular service changes. It does this by passing the old employer's rights and liabilities to the new employer. An employee will therefore transfer on the same terms and conditions and with their continuity of employment intact.
The law which applies in this area is notoriously complex and as such it is advisable to seek advice as soon as possible in order to ensure that you are fully aware of how TUPE applies to your situation. We are becoming increasingly recognised for our knowledge and expertise in this area and will make the process as straightforward for you as we can.
Whether you need legal advice because you are making a one off business purchase or sale or you are undertaking internal group restructuring we can help and support you. We can also offer help and support if you require ongoing advice because you provide outsourced services to clients or to other service providers.
We can clarify whether TUPE is likely to apply, explain the practical implications to you in your business and offer advice and assistance in helping you to comply with your obligations to inform and consult employees.
